Terms of Service

Welcome to PostPlan.io. These Terms of Service (“Terms”) constitute a legally binding agreement between you (whether individually or on behalf of an entity, “Customer”, “you”) and PostPlan Technologies Inc. operating as PostPlan.io (“we”, “our”, “us”). These Terms govern your access to and use of our all-in-one social media publishing, scheduling, developer API, and analytics platform.

1. Acceptance & Eligibility

By creating an account, accessing, or using PostPlan.io, you affirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), have the legal capacity to enter into binding agreements, and agree to be fully bound by these Terms, our Privacy Policy, and our Cookie Policy. If you are using the Service on behalf of a company or organization, you represent that you have full legal authority to bind that entity to these Terms.

2. Services & Account Security

PostPlan.io provides a simple, all-in-one social media scheduling, multi-network publishing, asset management, developer API, and analytics platform. You are solely responsible for maintaining the confidentiality of your account credentials, API keys, and OAuth connections, and for all activities that occur under your workspaces. You must notify us immediately of any unauthorized use or security compromise.

3. Customer Content & 100% Data Ownership

You retain 100% full, exclusive ownership of all content, copy, images, videos, captions, and intellectual property that you upload, compose, or publish through PostPlan.io.

You grant PostPlan.io a limited, worldwide, revocable, non-exclusive license solely to the extent technically necessary to store, format, optimize, and transmit your posts to your authorized third-party social media accounts at your direction. PostPlan.io never claims any ownership, copyright, or commercial rights over your content, and we will never sell or rent your content to any third parties.

4. Social Media Networks & API Platform Compliance

PostPlan.io interfaces with 12 third-party social platforms. By connecting your accounts and publishing content via PostPlan.io, you agree to comply strictly with each platform's terms of service, developer agreements, and community standards:

A. YouTube API Services (Google)

PostPlan.io uses YouTube API Services to schedule and publish video content to your connected YouTube channels. By using YouTube features within PostPlan.io, you agree to be bound by the YouTube Terms of Service and acknowledge that the Google Privacy Policy governs Google's processing of your data. You may revoke PostPlan.io's access to your YouTube data at any time via the Google Security Settings Permissions Page.

B. Meta Platforms (Facebook & Instagram)

You must comply with Meta Platform Terms, Instagram Community Guidelines, and Commercial Terms. You may disconnect your accounts or request data deletion anytime via account settings, or using our automated Meta Data Deletion Callback.

C. X (formerly Twitter) Developer Agreement

You agree to comply with the X Developer Agreement and Automation Rules. To prevent unauthorized link spam and vendor fee penalties, PostPlan.io enforces server-side URL management policies by default.

D. Other Connected Networks

You must strictly observe the developer terms and community guidelines of TikTok, LinkedIn, Pinterest, Threads, Bluesky, Snapchat, and Telegram. You may not use PostPlan.io to engage in automated harassment, coordinate inauthentic behavior, or violate rate limits.

5. Acceptable Use Policy (AUP)

You agree not to use PostPlan.io for any unlawful, deceptive, or malicious activities. Prohibited conduct includes:

  • Sending unsolicited commercial communications, link spam, or violating anti-spam laws (US CAN-SPAM, Canada CASL, EU ePrivacy, Australia Spam Act 2003).
  • Uploading or transmitting Child Sexual Abuse Material (CSAM), non-consensual imagery, terrorist content, or violence incitement.
  • Impersonating individuals, forging sender headers, or conducting deceptive identity fraud.
  • Interfering with platform security, reverse engineering source code, executing denial-of-service attacks, or bypassing workspace isolation controls.
  • Circumventing API limits, unauthorized automated scraping, or redistributing paid platform features.

6. Intellectual Property Infringement & DMCA

We respect third-party intellectual property rights. If you believe your copyrighted work has been infringed by content processed through PostPlan.io, please consult our formal DMCA & Intellectual Property Policy for instructions on submitting a takedown notice to our Designated Copyright Agent (dmca@postplan.io). Under 17 U.S.C. § 512(i), we maintain a strict policy terminating accounts of repeat infringers.

7. Subscriptions, Billing & Statutory Cancellation Rights

Billing Cycle: Paid plans (such as Pro and Agency) are billed in advance on a recurring monthly or annual basis via Stripe. Subscriptions renew automatically unless cancelled prior to the end of the current billing cycle.

Self-Service Cancellation: You may cancel your subscription at any time via the Billing portal in your dashboard settings. Upon cancellation, you retain full access until the end of your current paid billing period, after which your account reverts to the Free tier.

EU & UK Consumer Statutory Right of Withdrawal & Express Waiver

Under EU Directive 2011/83/EU on Consumer Rights (Article 16(m)) and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally enjoy a 14-day statutory right of withdrawal for distance contracts.

However, because PostPlan.io provides immediate digital access to software and cloud services upon subscription: By subscribing to a paid plan and accessing the Service immediately, you expressly request and consent to the immediate performance of the contract, and you acknowledge that you thereby waive and forfeit your statutory 14-day right of withdrawal once access to the digital services has begun.

8. Data Processing Addendum (DPA)

To the extent that PostPlan.io processes personal data on your behalf originating from the European Economic Area (EEA), the United Kingdom, or Switzerland, this section constitutes our binding Data Processing Addendum under Article 28 of the GDPR and UK GDPR:

  • Roles: Customer acts as the Data Controller; PostPlan.io acts as the Data Processor.

  • Subprocessors: Customer provides general authorization for PostPlan.io to engage subprocessors as listed in our Privacy Policy.
  • Data Return & Deletion: Upon termination, Customer may export all workspace data or execute permanent erasure via account settings.

9. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise. PostPlan.io does not guarantee uninterrupted or error-free operation, nor does it guarantee specific social media reach or engagement metrics.

To the maximum extent permitted by applicable law, in no event shall PostPlan.io or its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or third-party platform account suspension. PostPlan.io's total aggregate liability arising out of or related to these Terms shall not exceed the amounts actually paid by you to PostPlan.io in the twelve (12) months preceding the claim.

10. Governing Law, Dispute Resolution & International Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

International Consumer Protection Carve-Out:

If you are a consumer residing in the European Union, the United Kingdom, Canada, Australia, Japan, or Brazil, nothing in these Terms shall deprive you of the protection afforded by mandatory provisions of the consumer protection laws of your country of habitual residence, nor shall it deprive you of the right to bring proceedings in the competent courts of that jurisdiction.
