DMCA & Intellectual Property Policy

PostPlan.io (“we”, “our”, “us”) respects the intellectual property rights of creators and copyright owners globally and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512, “DMCA”), the EU Copyright in the Digital Single Market Directive (Directive (EU) 2019/790), the UK Copyright, Designs and Patents Act 1988, and applicable international laws, we maintain this formal notice, takedown, and counter-notification policy.

Email: dmca@postplan.io or copyright@postplan.io

Response Turnaround: Typically processed within 24 to 48 business hours.

2. Submitting a Notice of Claimed Infringement (Takedown Notice)

To be effective under 17 U.S.C. § 512(c)(3), your written notification must include substantially the following information:

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (such as exact post URLs, workspace identifier, or asset links).
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, physical address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to substantial liability for damages, including legal costs and attorney fees.

3. Counter-Notification Procedure (Restoration of Content)

If you believe that your post or media was removed or disabled as a result of mistake or misidentification, you may submit a written Counter-Notification under 17 U.S.C. § 512(g)(3) containing:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Northern District of California if outside the US), and that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will promptly provide the complaining party with a copy and inform them that we will replace or restore access to the removed material in 10 to 14 business days, unless the copyright owner files a court action seeking a restraining order against the subscriber.

4. Repeat Infringer Policy (17 U.S.C. § 512(i))

In accordance with the DMCA and other applicable international intellectual property laws, PostPlan.io has adopted a strict repeat infringer policy:

  • We track verified copyright infringement notices associated with user accounts and workspaces.
  • Users who receive three (3) distinct, non-countered, valid DMCA takedown notices within a twelve-month rolling period will have their accounts and access permanently terminated.
  • In cases of egregious or willful piracy, we reserve the right to immediately terminate the account upon the first notice without prior warning.

5. European Union & International Notice and Action (DSA Compliant)

For users and rightsholders within the European Union, this procedure also serves as our Notice and Action mechanism pursuant to Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065). If you believe any content published via our platform is illegal in the EU or infringes intellectual property rights under Member State law, you may submit a notice to dsa-compliance@postplan.io with the required legal justifications.
